The Marshall County Commissioners are making a request to the Indiana Department of Transportation for use of the abandoned sub district station by the Tri-way Golf Course off of old U.S. 31.
INDOT built a brand new sub district station in Plymouth just north of U.S. 30 off of Pioneer Drive.
Jason Durr from the Christopher Burke Engineering firm in South Bend requested GIS information on behalf of the Kankakee River Basin Commission.
Durr told the Marshall County Commissioners last week that the information will be used as a preliminary evaluation on basin assessment areas. He requested parcel data for the whole county, but the parcels directly affected by the Kankakee River Basin Commission may only be analyzed.
The Marshall County Commissioners last week opened bids for the Shady Rest farm ground lease for a period of three years.
Every three years the commissioners are required to lease out the farm ground area per statute. There are approximately 160 acres. Continue reading
Michelle Bachtel was before the Marshall County Commissioners on Monday morning to ask that the speed limit be omitted from the golf cart ordinance.
She made this request as she drives her golf cart on county roads to access her farm ground on the north side and the south side of U.S. 30 in the Inwood community. She was stopped by a Marshall County deputy who informed her that she could not operate the golf cart on the road. Bachtel explained to the commissioners that the ordinance allows the operation of golf carts on roads that have a posted speed limit of 35 mph or less and the road she utilized that day had a posted speed of 30 mph. The opioid crisis affects everyone and it is not being overlooked in Marshall County.
According to the Marshall County Health Department figures, the number of overdose deaths due to opioid and prescription drug abuse went from one in 2015 to 13 in 2016 and 16 already in 2017. County Attorney Jim Clevenger presented information to the Marshall County Commissioners Monday morning asking them to consider joining an Indianapolis firm to pursue opioid litigation in a multi-district, federal litigation against the manufacturers and distributors of highly addictive prescription medications. The Marshall County Commissioners will meet this morning with several items for discussion.
The commissioners will open bids for the lease on the farm grounds at the Shady Rest Home site. The building is not for lease, but the land surrounding the parcel is up for lease as it is every few years.
The Marshall County Commissioners will be reviewing two speed limit ordinances at their upcoming November meeting.
County Attorney Jim Clevenger told the commissioners this week that he’s still working on an ordinance that would reduce the speed limit on 10B Road adjacent to Ancilla College. It was suggested to lower the speed limit to 35 mph on that road for the safety of students who walk along the road by the Lake House. Clevenger is still researching the distance to include in the ordinance.
The Marshall County tax sale is set for next week.
County Attorney Jim Clevenger reported to the commissioners on Monday that the application for Judgment and Order for Tax Sale was filed on Sept. 22 and the last day for objections on unpaid taxes was on Tuesday. The Judgment and Order was obtained yesterday.
The Marshall County Commissioners will discuss the construction of a multi-purpose building at the Marshall County Fairgrounds in Argos when they meet this morning.
Shannon McLeod will be before the governing body to discuss the project spearheaded by the Marshall County 4-H Fair Association. The association was applying for an OCRA grant in the amount of $500,000 to assist in the construction of the building that the members hope will host many functions including wedding receptions, meetings and other community-type gatherings. The county will act as a pass-through vehicle for the purpose of obtaining the grant. County Attorney Jim Clevenger will present a memorandum of understanding between the county and the association that states that the county is not financially liable for this project.
The Marshall County Commissioners will soon approve a set fee for all violations in the violations bureau.
County Attorney Jim Clevenger said the problem is a number of the ordinances including abandoned vehicles, animals running at large and curfew, to name a few, don’t have specific monetary amounts given for frequent violations of the same ordinances. The officers don’t have a way of knowing if it’s a first, second or third violation.
Marshall County Highway Administrator Laurie Baker presented the commissioners with lease financing and tax exempt paperwork for the county’s new paver.
County Attorney Jim Clevenger went over a resolution indicating that the county is entering into the lease purchase and agreement is approved substantially. A requirement to verify insurance was also included which was already complete. A list of all proposals considered by the commissioners has to be submitted and that the process was competitive.

The Marshall County Commissioners were informed by County Attorney Jim Clevenger that the fees for the recorder’s office need to be updated.
Recorder Marlene Mahler informed Clevenger that the state legislature mandated changes in the fees at the state level and those fees are to be updated at the county level. Clevenger said he drafted an ordinance that updates the fee schedule in the recorder’s office that matches the state mandate.
The Marshall County Commissioners will hold two public hearings this morning when they meet for their regular meeting today.
The hearings will allow residents to comment on the proposed fee schedule changes in the health department and the changes in the well ordinance. The hearings are set to begin at 9 a.m. as advertised.
The Marshall County Commissioners approved additional readings to the proposed ordinance that reestablishes the Cumulative Capital Development Fund at its maximum rate at $.0333 per $100 of assessed valuation.
No additional comments were made concerning the details of the ordinance. The second and third readings were unanimously approved.
The Marshall County Commissioners got an update on a class-action lawsuit against a company who allegedly stole thousands of dollars worth of data from the recorder’s office.
County Attorney Jim Clevenger told the commissioners that the lawsuit involves Marshall County and several other counties against Black Knight Real Estate Data Solutions. Recorder Marlene Mahler previously told the commissioners that the company reportedly took 2,700 documents totaling 39,000 pages out of the computer system without going through the proper channels. The recorder’s office would normally charge $1 per page so the company would owe $39,000. The lawsuit seeking damages would triple that amount.
The Marshall County Commissioners will meet for the last time this year today at 8:30 a.m. ET.
The commissioners will review the county’s contract with the Muskegon River Youth Center. The probation department had a previous contract with the juvenile detention facility in Muncie but operations have moved to a new location in Evart, Indiana. The 2014 contract expires today.
Marshall County Attorney Jim Clevenger and Marshall County Recorder Marlene Mahler discussed with the commissioners this week the theft of 2,700 documents totaling 39,000 pages out of the county’s computer system.
Clevenger noted that several other counties are facing the same issue with the same company and have been asked to join a multi-county action against the company. Representatives of LPS Real Estate Data Solutions reportedly went in and took data out of the recorder’s office without going through the proper channels to pay for the data wanted. A civil action will be filed against LPS to recover damages for the stolen data and punitive damages.
The Marshall County Commissioners recently discussed a Memorandum of Understanding to continue the Meals on Wheels program at the Marshall County Council on Aging.
County Attorney Jim Clevenger stated that the current agreement expires Dec. 31 of this year and it needed to be renewed. The agreement allows the meals to be cooked at the Marshall County Jail at a cost of $3.25 per person. The personnel at the Marshall County Council on Aging pick up the meals at the jail and deliver them to those in need.
The Marshall County Commissioners discussed a contract between the county and Quality Correctional Care, LLC.
Quality Correctional Care, LLC provides the jail’s healthcare needs. The company has provided pharmaceutical needs, a full-time nurse and doctor visits since October of 2013. County Attorney Jim Clevenger explained that the new contract would be for a four-year term at a cost of $153,000 for the base compensation per year. That figure would not change throughout the duration of the contract. Some add-ons are also available. The monthly cost would be $12,750. A doctor will visit once a week along with a psychologist and a nurse will be there 40 hours a week.
