David’s Courage, Inc. and Marshall County Arrive at Transfer Agreement

The transfer contract between David’s Courage, Inc. and Marshall County for occupancy of the Shady Rest Home has been approved with a few modifications.

According to County Attorney Jim Clevenger, facilitators Gregg Erickson and Ted Hayden asked the commissioners to drop the requirement that the facility continue to be named Shady Rest Home. A different designation was not provided at the time of discussions.

Marshall County Commissioners to Meet Today

The Marshall County Commissioners will meet today.

Marshall County Highway Supervisor Jason Peters will present the 2018 proposed road plan to the commissioners. Marshall County Museum Executive Director Linda Rippy will have her quarterly report and Health Administrator Christine Stinson will present a nomination for the board of health.

Marshall County Commissioners Discuss Proposed Program at Shady Rest Facility

The Marshall County Commissioners discussed the Shady Rest Committee’s recommendation of allowing the addiction recovery program, David’s Courage, to be run out of the Shady Rest Home on Lincoln Highway in Plymouth.

Committee Chair and County Commissioner Kurt Garner explained that the committee approved a favorable recommendation for the program and if the commissioners did not decide to approve the program then the county would divest the property.

Marshall County Commissioners Discuss Copier Agreement

The Marshall County Commissioners were presented with a master agreement for the lease or purchase of copy machines for all county departments.

County Councilman Bill Githens worked with Ricoh representative Patrick Nau to formulate an agreement to be presented to County Attorney Jim Clevenger for review. There are five departments who have copier replacement requests in their budgets this year and it is the hope that this contract would save the county thousands of dollars in copier leases or purchases and maintenance and service fees.

Argos Clerk-Treasurer Seeks Approval of Intergovernmental Agreement

Argos Clerk-Treasurer Lisa Mullaney asked the Marshall County Commissioners to consider an intergovernmental agreement between the county, Town of Argos and Building Commissioner Chuck DeWitt for building and planning services.

The Town of Argos is looking toward economic growth. Mullaney said town officials need help with planning and Board of Zoning Appeals assistance to move forward. Mullaney commented that the members of these boards are volunteers and not qualified professionals so guidance from DeWitt would be appreciated.

Intergovernmental Agreement Pertaining to Planning Services to be Reviewed Monday

The intergovernmental agreement between Marshall County and the City of Plymouth for planning services with Planning Director Ralph Booker will be discussed by the Plymouth City Council members on Monday.

County Attorney Jim Clevenger told the Marshall County Commissioners on Tuesday morning that Plymouth City Attorney Sean Surrisi was off much of the last part of December and didn’t have a chance to review the paperwork prior to Tuesday’s commissioners meeting.

Marshall County Commissioners Consider E-Gov Contract

The Marshall County Commissioners discussed an E-gov contract with IT Director Michael Marshall last week.

Marshall presented the contract at a previous meeting which calls for a contract with E-gov out of Indianapolis for web hosting and web design. He said they have the skills necessary to produce a user-friendly county website and give it a fresh look. Marshall said he would still be responsible for content.

Haeck Court Hearing Continued

A hearing to consider a motion to return restitution in the case of former Marshall County Highway Superintendent Neal Haeck has been continued until Thursday, Jan. 4.

Marshall County Prosecutor Nelson Chipman told MAX 98.3 FM News that Marshall County Superior Court No. 1 Judge Robert O. Bowen was unable to be in court on Thursday for the 9 a.m. hearing so it was continued. Prosecutor Chipman said it’s preferred that Judge Bowen preside over this hearing.

Marshall County to Join National Opioid Litigation

Marshall County will join an Indianapolis firm in pursuing a multi-district, federal litigation against the opioid manufacturers and distributors of highly addictive prescription medications.

The Marshall County Commissioners discussed the issue in detail in an executive session in November. During their regular business meeting on Monday morning, Commissioner Mike Delp asked about fees to be collected by the firm Cohen and Malad. The firm handling the case would collect 33.3% in attorney fees and any expenses incurred in the event of a recovery. The expenses will be shared with all clients in the litigation process.

Marshall County Commissioners Wait to Make Restitution Decision

The Marshall County Commissioners will wait to make a decision on whether or not restitution will be paid to former Highway Superintendent Neal Haeck.

Haeck was accused of stealing money from the sale of scrap metal while acting in his position held in the county in 2012 and 2013. Haeck maintained his innocence from the time he was accused of the action in 2014, but he was found guilty on one count of theft during a two-day trial in March of 2016. He was ordered to pay restitution in the amount of $12,358.41, which was paid in full to the county, plus court costs and fines. Continue reading
