Marshall County Commissioners Hear Attorney Report, ACLU Lawsuit Dismissal Signed and Notice Prepared

MARSHALL COUNTY — Marshall County Attorney Jim Clevenger updated the Marshall County Commissioners this week that the dismissal paperwork for the American Civil Liberties Union (ACLU) lawsuit has been signed and notices have been prepared. That paperwork is still in a waiting period before it can be submitted to the judge for final approval of the dismissal agreement.

The legal and financial team is still waiting for direction from the Marshall County Council on the Jail Refunding Bonds. In his report, Clevenger noted that he has requested direction but has been given none apart from being updated that there are “other issues” in addition to taking advantage of a lower bond interest rate.

Marshall County Circuit Court Judge Curtis Palmer took a motion under advisement to dismiss the plaintiff’s complaints in the VIP Ventures et al (Van Hawk) v. Marshall County.

Clevenger also updated the Commissioners that the Marshall County Council approved the joint resolution authorizing a petition to the Indiana Department of Environmental Management (IDEM) to establish a Marshall County Sewer District for 13 service priority areas. That petition is complete and will be filed on March 24 in compliance with the mandatory 30 day waiting period after the public hearing.

IDEM has a series of steps before final approval which will include a public hearing and another opportunity for the public to provide feedback.

All of the paperwork was submitted for the Opioid Settlement. Clevenger had no confirmation as of Monday regarding whether the bankruptcy plan submitted by the pharmaceutical company had been granted.
