Marshall County Commissioners Hold Special Meeting, Vote to Change Leadership by Majority

The Marshall County Commissioners held a special meeting Wednesday afternoon to clarify certain procedures. 

Commissioner Kevin Overmyer brought to the attention of those present an email by County Attorney Jim Clevenger clarifying the duties of the commissioners as the executive branch of government in the county.  The commissioners approve contracts, all claims, as well as establishing procedures for county departments, offices and agencies, and supervise offices, departments and agencies. 

He commented that he has seen some actions that have crossed the line. While he said it is the county council’s ability to hire their own counsel and consultant for council-related responsibilities and items, he said any department contracts or other county actions that should be directed to the county attorney continue to be reviewed by Clevenger as it has in the past.  That was in the form of a motion and it was approved by all three commissioners.

The Marshall County Council has agreed to hire an attorney for legal advice and a consultant to help look at the budget and how to best manage the county’s funds, which is acceptable.  Overmyer said contracts concerning those appointments have not been reviewed by the commissioners.

Clevenger commented that the council should remain mindful of their duties of the fiscal body and those of the executive branch. 

Commissioner Stan Klotz encouraged both the commissioners and the council to sit down to discuss business and do what is best for the public.  Clevenger also encouraged that the government bodies cooperate to do what is best for the residents.

However, Overmyer said he believes the leadership of the commissioners needs to change.

“I feel that the leadership has not protected the integrity of this body of commissioners or this executive body,” stated Overmyer.  “I would like to make a motion that Stan and Mike [Burroughs] reverse roles that Mike becomes president and Stan becomes the vice president of the commissioners.  I know it’s unusual, but I think it’s something that will benefit everybody.”

Klotz asked Overmyer, “You’re basing this on the fact that I don’t agree with some of your positions?”

Overmyer responded, “I just am basing this on what I’m seeing.”

Klotz asked Clevenger if that could be done, and Clevenger said it could be done if they believe the circumstances should lead to that action.

The motion was seconded by Commissioner Michael Burroughs.  The motion passed with Overmyer and Burroughs voting in favor of the motion and Klotz opposing the motion.
