Marshall County Commissioners Hold Public Hearing on Zoning Ordinance Changes

Marshall County Plan Director Ty Adley presented several zoning ordinance changes for consideration by the Marshall County Commissioners last week.

Adley explained that the amendments involved adding demolitions in the exemptions clause for Technical Review cases for Lake, Commercial and Industrial grounds when going through building permits.

Another amendment involved setback updates for Town and Lake Districts as well as the C1 District.  Town and Lake Residential Districts will have reduced side yard setbacks and the C1 District will have a reduced setback in downtown areas.

Adley noted that the building permit expirations were amended.

Adley stated, “When you get into the difference between a building permit that’s associated with a BZA case and one that is not there’s two different timelines associated with that.  Article 9 has a restriction of two years from the date of BZA approval, whereas your standard building permit does not have that restriction is also eligible for extensions which has been highly used given the difficulty in acquiring building products over the last few years. It would be on the same level playing field for timeframe that a standard building permit would see.”

An effort to clarify setback distance associated with towers that is supported by Indiana Code was added, as well as reordering the chapters in the Subdivision Ordinance.

The changes were up for public comment in a hearing opened by the commissioners, but there were no public comments.

The commissioners unanimously approved all of the amendments on first reading and then suspended the rules and unanimously approved them on second and third readings.
