Culver Town Council Approves Rezoning of 415 Lake Shore Drive on First Read

The Culver Town Council approved Ordinance 2022-003 -Rezone 415 Lake Shore Drive from Commercial to Planning Unit Development (PUD) on first read during the meeting Tuesday. The Culver Plan Commission favorably recommended the rezone after a public hearing and meeting held last month.

During public comment, Attorney Stephen R. Snyder of Snyder Morgan Federoff & Kuchmay LLP advised the council that he had filed a petition on Monday in Marshall County Circuit Court Judge Curtis Palmer’s Court for a judicial review of the determination made by the Plan Commission.

Snyder represents clients Doug Farmer, Bob Darovic, Matt Nagel ,and Jeff Mansfield. Snyder advised the council that the ordinance was defective for several reasons. Member Rich West recused himself from the vote to avoid conflict of interest. Other members voted in approval of the ordinance on first read. The item will be on the agenda for the May 24 meeting for second read.
