Culver Town Council Holds Hearing Concerning Disannexation Petition

The Culver Town Council members opened a hearing Tuesday night to accept comments concerning a petition for disannexation of a property on West Cass Street.

Susie Mahler spoke behalf of Cord Associates who also represented the buyer, Brandi Pohl, in this matter. According to Mahler, Pohl asked to purchase the property to start a daycare facility at that location. 

Pohl testified that it was rezoned and annexed with permission from Cord Associates and approval of the Plan Commission, Board of Zoning Appeals and the Culver Town Council, per the requirements of Pohl’s small business loan application.  She said the property appraised, but the improvements did not and the sale fell through.

Mahler said it was agreed that if all facets moved in the right direction, then the entire process would be final, but since the deal fell through, a petition was filed to disannex the property from the town limits and return it to the Marshall County tax rolls. 

If the annexation was ordered to remain, the owners would pay $2,500 in taxes a year compared to $147 a year on the 2.67 acre property.

When asked if any improvements were made to the structure or any town utilities were installed to this property, Mahler indicated that no such improvements were made. 

No other comments were made either supporting or declaring remonstrance of the petition. 

The Culver Town Council approved the petition to disannex the property with a unanimous vote.
