Culver Town Manager Jonathan Leist updated the town council members on a recent request to disannex a piece of property on Cass Street.
The parcel was annexed into the town to accommodate plans for a childcare facility at that location, however plans fell through and now the owners want to finalize paperwork to return that land back to the county taxing district.
Leist said he and Town Attorney Jim Clevenger have been talking to the Marshall County Assessor about the process. They’ve also had discussions with the property owners.
“It sounds like if there’s not a big impact on their taxes, they may be willing to leave it in town. Jim and I are trying to figure that out and we’ll report back,” said Leist.
According to Clevenger, there should not be any tax impact if the annexation remains as recently adopted. However, the parcel may need to go back to the original zoning of S-1.
If the property owners decide to move forward with disannexation, a formal petition would need to be filed with several points of information in order to follow the state statute regarding disannexation. Once the petition is filed, a public hearing needs to be held to hear all comments for or against the disannexation. Following that public hearing, assuming there is no opposition, if the town council agrees with the disannexation, the notice would be published and then reported to the auditor’s office for filing.
