Bremen Town Council Adopts UTV Ordinance

The Bremen Town Council members adopted a UTV, or off-highway vehicle, ordinance during their meeting Monday, January 13.

The ordinance references Indiana Code that describes a “recreational off-highway vehicle” as a motorized, off-highway vehicle that is 80 inches or less in width, has a dry weight of 3,500 pounds or less, and is designed to travel on least four non-highway or off-highway tires. In addition to the statutory definition the off-highway vehicle, the off-highway vehicle has a non-straddle seat or saddle, and has a steering wheel for steering control.

The operator must follow the rules of the road and must be at least the age of 18 to operate on the streets and alleys in the Town of Bremen. Proof of financial responsibility must be provided and it must be registered with the Indiana Bureau of Motor Vehicles and/or the Indiana Department of Natural Resources. The off-highway vehicle can not be used to hunt, pursue, or kill a wild or domestic bird or wild animal within municipal limits.

The off-highway vehicle shall not carry more passengers than as recommended by the manufacturer. Any person shall not hold passengers, animals, or anything else in their hand, hands or on a lap while the off-highway vehicle is in operation.

Off-highway vehicles may not operate in any park, including on any property owned or controlled by the Bremen Park Board, on any private property without permission by the owner, or any municipal or state street or highway not permitted by the Town of Bremen or the State of Indiana.

Any person in violation of the ordinance more than three times in any calendar year will be suspended of having the privilege of operating recreational off-road vehicles in the town. Any resident with suspended privileges may petition the Bremen Town Council, in writing, for a hearing for the consideration of reinstatement.

The ordinance will be in force 30 days after publication.
