Marshall County Sheriff’s Department Respond to Weekend Accidents, Drivers Allegedly under Influence of Alcohol

Three people were arrested over the weekend for allegedly driving under the influence of alcohol in three separate vehicle accidents in Marshall County.

Marshall County Sheriff’s Department deputies were called to a two-vehicle accident in the area of U.S. 31 and Michigan Road Friday, April 1 after 5 p.m. ET where one vehicle reportedly left the scene.  An off-duty deputy stopped the vehicle and found the driver to be James W. Downey of Argos, according to the report.  Upon further investigation, police say Downey was intoxicated and he was arrested on preliminary charges of operating a vehicle while intoxicated endangering, operating a vehicle while intoxicated with a BAC of .15% or more, and leaving the scene of a property damage collision.  He has since bonded out of the Marshall County Jail on a cash bond.

Later Friday evening just before 9 p.m. ET, Marshall County deputies responded to an unknown injury accident in the area of U.S. 30 and Fir Road.  An investigation found that 32-year-old Christy Henderson of Elkhart was allegedly under the influence of alcohol.  She was arrested on a misdemeanor charge of operating a vehicle while intoxicated.  She was later released from the Marshall County Jail after posting a cash bond. 

Marshall County deputies were called to the area of U.S. 31 and U.S. 6 for a two-vehicle accident Sunday just after 5 a.m. ET.   A pickup driven by Tristen Moyer of Plymouth was traveling northbound in the southbound lanes and struck a southbound vehicle, according to the report.  Police say only minor injuries were reported.  Moyer was allegedly found to be over two times the legal limit of alcohol.  Moyer was arrested on a preliminary charge of operating a vehicle with a BAC of .15 or more.  He was later released from the Marshall County Jail after posting a cash bond.

Suspects are presumed innocent unless or until proven guilty in a court of law.
