PLYMOUTH — The Plymouth Common Council denied the application to vacate submitted by Audrey and Phil Blessman regarding the easement that runs alongside their property located at 116 S. Liberty St.

During the public hearing Monday, the council heard comments from Audrey, the attorney they hired to represent them, and several residents impacted by the obstruction to the easement created by the fence.

Marshall County Circuit Court Judge Curtis Palmer had already heard the case and ordered the removal of the fence and allowed the Blessman household until April 30 to comply.

After a lengthy discussion by all parties, the council denied the application to vacate the access easement, thus retaining the alley as property of the City of Plymouth.

The Blessmans have until April 30 to comply with the court order. If they do not remove the fence, the City of Plymouth has been given the authority to remove and dispose of the fence on or after May 1.
