Marshall County Commissioners Consider Soil Erosion Control Ordinance Amendment

The Marshall County Commissioners reviewed an ordinance amendment Monday morning that deals with soil erosion in a building project.

Plan Director Ty Adley explained the purpose of the ordinance is to reduce flooding and erosion, reduce impact to roadway infrastructure which saves the county money from impacts to bridges and roadways, and to reduce impact to residential property.

The commissioners previously discussed this ordinance amendment but asked the Plan Commission to revise it. Bigger square foot areas are now being proposed in this ordinance amendment. 

“Any construction which disturbs more than 4,000 square feet per project and/or 6,000 square feet of cumulative surface area must comply with the Marshall County drainage and sediment control ordinance,” said Adley.

Adley commented that waivers can be granted which will be under scrutiny by Adley and Surveyor Craig Cultice.

“We both agree to sign off on the waiver.  It’s essentially all based on what kind of soils do you have and how’s the water running on your property today.”

The commissioners unanimously agreed to suspend the rules and pass the ordinance on all three readings.
