The Indiana Court of Appeals determined that oral arguments will be heard in the case of the Town of Culver vs Scotty Van Hawk and the 27 Group, the owner of the old City Tavern Building at 415 Lakeshore Drive.
The Town of Culver filed court paperwork last year in order to address the issues that plague the former City Tavern building. According to the Affidavit filed in court in the matter, the building has not been occupied for four years. The document also states that the walls suffer from damage, animals can get into the structure as the doors and windows are not securely covered, the foundation is cracked and crumbling, the interior ceiling is caving, water damage and mold exist, and an offensive odor emits from the building.
The building was deemed unsafe and set for demolition which was appealed by the 27 Group LLC and Scotty Van Hawk.
Culver Town Attorney Jim Clevenger told the town council members last week that the hearing is set for Monday, Oct. 28 at 1:30 p.m. ET at the Eugene and Marilyn Glick Indiana History Center in Indianapolis. The scheduled panel members are Judges Riley, Robb and Bradford. Residents can attend the hearing, but no comments will be taken from citizens.
Clevenger believes the hearing will be recorded. It can be accessed online within 48 hours following the hearing at www.in.gov/judiciary.
