The owners of a property on West Cass Street filed a letter with the Town of Culver wishing to disannex a parcel.
The parcel was annexed into the town to accommodate plans for a childcare facility at that location, however plans fell through and now the owners want to finalize paperwork to return that land back to the county taxing district.
Culver Town Attorney Jim Clevenger noted that even though the letter was a form of notice, a formal petition needs to be filed with several points of information needed in order to follow the state statute regarding disannexation. Once the petition is filed, a public hearing needs to be held to hear all comments for or against the disannexation. Following that public hearing, assuming there is no opposition, if the town council agrees with the disannexation, the notice would be published and then reported to the auditor’s office for filing.
Clevenger said this particular parcel is surrounded by town property and would make sense if it would stay annexed in the town. The annexation would be a better selling point if the owner sells it.
The council agreed with Clevenger’s suggestion to send a letter to the owners explaining the proper process of disannexation as outlined in the state statute. Clevenger will send the letter on behalf of the town.
