Culver Town Council Adopts Zoning and Subdivision Ordinance

The Culver Town Council members took action this week on an ordinance that amends the Zoning and Subdivision Ordinance.

There was one portion of the ordinance that the council members sent back to the Plan Commission with recommended wording pertaining to existing non-conforming structures with plans to add a story or completely raze the building and build a new structure.  The initial change stated that a person can build on the same foundation, but the structure cannot be outside of the perimeters of the original construction.  The structure can be taller up to 35 feet, but the other boundaries must remain the same.

After discussion, the Plan Commission members agreed to wording where “a structure can be rebuilt upon existing foundation lines, provided that the height of the replacement structure may not exceed the height of the structure that was destroyed unless a variance is approved by the Board of Zoning Appeals.”

The other portion of the ordinance amendment includes updates to include the complete streets policy, catch basin specifications and flood control standards, height restrictions and establishing grade for clarification, the definition of public and private sewers, system of treating private wastewater that is limited in scope and relies on onsite system treatment, system of treating public wastewater that lawfully accepts effluent from multiple households or residences, and general formatting corrections.

The changes were approved on first reading of the ordinance in a special meeting on Aug. 29.  The council this week approved the second and third readings of the ordinance with a unanimous vote.
