Culver Town Council Discusses Unsafe Properties

An unsafe property on Lakeshore Drive in Culver will sit in its current state until an appeal is decided in the Indiana Court of Appeals.

The Town of Culver filed court paperwork last year in order to address the issues that plague the former City Tavern Building at 415 Lakeshore Drive.  According to the Affidavit filed in court on the matter, the building has not been occupied for four years.  The document also states that the walls suffer from damage, animals can get into the structure as the doors and windows are not securely covered, the foundation is cracked and crumbling, the interior ceiling is caving, water damage and mold exist, and an offensive odor emits from the building.      

A demolition order was granted by Marshall County Circuit Court Judge Curtis Palmer on Jan. 22, but those associated with the ownership of the building appealed the order within the allowable time.  A brief on an appeal was filed by the attorneys for the 27 Group, LLC and now Culver Town Attorney Jim Clevenger will provide a brief on behalf of the Town by June 2.  A reply may be filed 15 days after that.  The Court of Appeals may take up to eight months to arrive at a decision. 

In another matter, Clevenger told the Culver Town Council that a demolition order at a residence at 709 Obipso Street is on hold as the Judge in the case believed that the owner is making progress at the home and he hopes to sell it.  The next court date on the matter is set for Aug. 8.
