There are a few Township Advisory Board positions in Marshall County that aren’t filled from the November General Election.
County Attorney Jim Clevenger explained to the Marshall County Commissioners this week that there are several township advisory board seats where the existing members did not file for candidacy and no other candidates filed for the available seats. At the same time, resignations have not been received by current elected members to vacate the seats.
Clevenger said by law if the current township advisory board member doesn’t refile and there is no one new elected to take over the seat, the candidate stays in that position for another term unless a written resignation is filed with the county clerk. At that time, the precinct committee members can take action to fill the vacant position.
Clevenger said there is only one way the commissioners’ involvement would be needed.
“The only way the commissioners come into play is if there are two people that didn’t sign up and there’s a three member board and there’s only one seat that needs to be filled,” explained Clevenger. “The law provides that the county commissioners select which of those two un-filed members, that are kind of being carried over, takes that seat.”
Clerk Deb VanDeMark is working to notify the township board members to see if they are wishing to resign and that matter can be taken care of. In that case, then the township trustee will need to move along with the selection process.
