Felony Operating while Intoxicated

On March 9 at 8:22 pm,​ Marshall County Sheriff’s Department deputies were called to the area of 2A Road and Tamarack for a possible impaired driver.

Deputies located a dark colored Honda stopped at 2A Road and Tamarack. Police say the driver,​ Ma Lay, 38, of Bremen, had been drinking. Lay was offered a certified test and he consented. The result of the blood test found Lay to be over three times the legal limit, according to the report.

He was taken to the Marshall County Jail for a preliminary charge of driving a vehicle while intoxicated and charged with a felony due to having a prior conviction.

Suspects are considered innocent unless and until proven guilty in a court of law.
