Suspect Arrested on Charges of Resisting Law Enforcement, Battery by Bodily Fluid

A suspect was arrested Tuesday, May 21 after two Plymouth Police Department officers served a no trespass order.

Police Chief John Weir and Assistant Police Chief Matthew Emenhiser went to serve 61-year-old Jan Lemler with a no trespass order from a criminal mischief case involving Lemler at the Plymouth City Office. Lemler allegedly became agitated with the no trespass order and proceeded forward at the officers. Lemler was advised to step back and the no trespass order was placed with Lemler’s belongings and police say Lemler proceeded forward at Chief Weir and spit on him.

Lemler was then taken to the ground and Lemler was taken into custody, according to the report. Lemler was booked into the Marshall County Jail on preliminary charges of battery by bodily fluid and resisting law enforcement.

Formal charges will be determined by the Marshall County Prosecutor’s Office.

Suspects are presumed innocent unless and until proven guilty in a court of law.
