Kenneth Lain appeared in Marshall County Superior Court No. 3 Thursday morning where he pleaded guilty to a Level 6 Felony charge of neglect of a dependent.
Lain was arrested on the charge following the recovery of the body of his daughter, 11-month-old Mercedes Lain. Lain and the daughter’s mother, Tiffany Coburn, left Mercedes Lain in the care of 37-year-old Justin Miller who took the child’s life the day before this charge.
Marshall County Deputy Prosecuting Attorney Nick Langowski asked Lain about the conditions of his room where he and his daughter lived in the Economy Inn to which he admitted that trash and dirty clothes were inside the room. He admitted that there was drug paraphernalia in the room and that the child could have gotten access to it if it was out in the open.
Judge Sarber accepted the plea agreement during Thursday’s hearing. The plea agreement calls for the sentence to be left to the court’s discretion with the range of penalties for a Level 6 Felony. A sentencing hearing is scheduled for Friday, February 18, at 10 a.m. ET.
Coburn was also in court Thursday morning where a plea agreement was submitted to the court. She is also charged with a Level 6 Felony of neglect of a dependent. A plea and sentencing hearing in her case is set for Friday, February 25, at 10 a.m. ET in Marshall County Superior Court No. 3.
