A Bourbon man and a Walkerton man are accused of impaired driving in separate incidents in Marshall County over the weekend.
On Saturday, Nov. 30, just before 6 a.m., a Marshall County Sheriff’s Department deputy found a vehicle moving slowly down the side of Michigan Road near 4A Road. The vehicle eventually stopped. Police say the driver, 32-year-old Saul Antonio Cerrato, of Bourbon, was found inside the vehicle and under the influence of alcohol. He was taken to the hospital where a certified test was conducted which later found Cerrato to be over the legal limit to be operating a vehicle, according to the report. Cerrato faces preliminary charges of operating a vehicle while intoxicated endangering a person, operating a vehicle with a BAC of .08 or more and operating a vehicle without ever receiving a license.
Then on Sunday, Dec. 1, a traffic stop in the area of U.S. 31 and 11th Road after 4:30 a.m. found the driver, 34-year-old Sean Fleming, to be under the influence of alcohol, according to police. The report says a certified test conducted at a hospital found Fleming to be over three times the legal limit of alcohol to operate a motor vehicle. He was booked into the Marshall County Jail on preliminary charges of operating a vehicle while intoxicated endangering a person and operating a vehicle with an ACE of .15 or more. Fleming has since bonded out of jail.
Suspects are presumed innocent until proven guilty in a court of law.
