Plymouth BOW Takes Action to be able to Eventually Recoup Demolition Costs through Lien

Plymouth City Attorney Sean Surrisi recently provided the Board of Public Works and Safety members with an update about the East Jefferson Street property slated for demolition. 

He presented members with documents that included the proposed findings of fact and conclusions of law regarding the property at 404 East Jefferson Street when they met for their final meeting in November.

He noted, “It kind of recounts the series of events with that property, your prior affirmation of a demolition order and what’s occurred since then.”

Surrisi explained why the board members were being asked to take action on the matter.

He stated, “We’d like to get this along with the initial order recorded which is one of the steps toward, once we’ve actually incurred the cost of demotion, moving toward getting a judgment for our costs entered as a lien on the property.”

The board members voted unanimously to approve the documents as presented.

In addition to submitting that for consideration, Surrisi also noted that demolition contractor said they’d be ready to do the work after Thanksgiving and NIPSCO was expected to have utility lines in the area retired prior to December 5th.

The old Clarke station at that location has been vacant for some time.  It was deemed an unsafe structure and was affirmed by the Plymouth Board of Public Works and Safety for demolition in August
