Bremen Town Attorney Anthony Wagner informed the Bremen Town Council members Monday afternoon that there is a problem with the deed to the Jackson Street property.
Wagner said he filed a deed, but it was rejected.
Wagner explained that there is a gap in the chain of title for the property at 121 S. Jackson Street. The sheriff’s sale deed was not recorded and he said he doesn’t know who has it. The winning bidders of the property in a sheriff’s sale transferred the property to the town, but there wasn’t a transfer made to the winning bidders.
Wagner said he’ll work at trying to get the deed with the mortgage foreclosure company, or they will double check with the winning bidders to make sure it’s not in their possession.
The town exercised eminent domain in order to obtain the property for a public purpose. The town plans to demolish the structure on the property and use that space for a larger streetscape project in a flex street. A flex street allows daily traffic and parking while being flexible and accessible for events and festivals. There are no curbs which allows as a shared space for vehicles and pedestrians. A pavilion will be in the middle of the road.
