A Plymouth man was sentenced to 12 years in prison on a charge of aggravated battery of an 18-month-old child left in his care.
According to Marshall County Prosecutor Nelson Chipman, Jamie Lee Elsea, 25, pleaded guilty in a plea agreement with the state on the Level 3 felony charge but left the sentence up to Marshall Superior Court No. 1 Judge Robert O. Bowen. Charges of neglect of a dependent resulting in serious bodily injury and attempted murder were dismissed with the acceptance the plea agreement.
According to court documents, on Nov. 10, 2016, an 18-month-old child was left in Elsea’s care. Plymouth Police were called to the home where the child was found unresponsive. When Plymouth Police officers interviewed the attending physicians at the hospital, it was determined that the child was suffered many injuries consistent with violent shaking of the child.
When in court on Wednesday Prosecutor Chipman said Elsea admitted to facts that supported an aggravated battery charge.
Chipman noted that as a statutory crime of violence, Elsea will have to serve 85 percent or 10 years and 2.5 months before he will be eligible for release.
