Operating while Intoxicated, Resisting

On Feb. 2,​ at 3:30 p.m. ET, Marshall County Sheriff’s Department deputies were requested to respond to a report of a suspicious vehicle ​and person in the 10000 block of Hawthorn Road.

The caller stated the vehicle was occupied by an unconscious man with his pants down and possibly armed with a firearm. Upon the arrival of Marshall County Sheriff’s Department deputies and an officer from the Bourbon Police Department,​ the man became conscious and was identified as 35-year-old Christopher Montgomery.

Montgomery was suspected of being under the influence of alcohol and drugs. Open alcohol containers and suspected drugs were located in the vehicle, according to the report. While on the scene,​ police say Montgomery resisted law enforcement. He was transported to the hospital for his injuries and a chemical test.

Montgomery was then booked into the Marshall County Jail on preliminary charges of resisting law enforcement,​ operating a vehicle with an ACE of 1.5 or more,​ and possession of marijuana. The Marshall County Sheriff’s Department was assisted by the Bourbon Police Department and Plymouth EMS.

Suspects are considered innocent unless and until proven guilty in a court of law.
