Water Improvement Project Division 1 Discussion Tabled on $14,250

The Plymouth Board of Public Works and Safety tabled a discussion regarding the contract on the Water Improvement Project Division I which was awarded to TGB Limited for their bid amount of $1,251,580.

The original bid set showed the line running from Lake Avenue, under the railroad tracks, all the way to the north side of LaPorte St. at Plum St.

As an addendum, a copy of the permit agreement with CSX Railroad, which is required to bore under the railroad.

When CSX sent out that agreement, that was included in the addendum, they attached a drawing that was a preliminary drawing from 2021 that was submitted along with the application for the railroad permit. When the contractor got the addendum with the railroad agreement with the Exhibit A attachment which was only the preliminary drawing – they interpreted that as an updated bid set drawing. The disagreement is that the bid set is clearly labeled bid set and stamped by the engineer.

The drawing that was attached as an exhibit to the railroad agreement is clearly labeled preliminary – not for construction – and is not stamped by an engineer.

The contractor’s position is that because the drawing came later in time it controls. The engineer’s position is that the drawing that came later in time was nothing more than an exhibit attached to the railroad agreement.

The $14,250 requested is the amount that will be required to extend the line the additional length because of the depth he has to go under the sewer line.

The Board of Public Works and Safety heard statements from both sides, tabled the discussion and asked the engineer and the contractor to reach an agreement to be presented by Utilities Superintendent Donnie Davidson at the next meeting.

Division 1 portion of the project includes the water distribution project of the replacement of a water main on Jefferson Street, a new 12” water main and a new 6” water main to loop the water system near Gilmore Street/Yellow River crossing, and a new water main to loop the water system along Plum Street.
