The City of Plymouth Common Council approved the vacation and abandonment of easement for the parcel between the Goodwill and Arby’s.
According to City of Plymouth Attorney Jeff Houin, in the course of locating utilities, contractors working for the developer of the property discovered an existing easement for electrical lines that run to the advertising billboard located on US 30.
To correct the easement, the developer wants to abandon the existing easement.
According to Houin, there is not enough documentation to clarify the right of that easement if abandoned so the City of Plymouth has been asked to abandon any rights to that easement.
The City of Plymouth doesn’t have any utilities within the easement area and does not have any need for utilities in the area.
There is no reason to think that the City of Plymouth has any legal interest in the easement area, but since that cannot be confirmed from the original easement grant, the developer asked the City of Plymouth to confirm that there is no need for the easement and would not claim any rights.
The City of Plymouth released, relinquished, vacated, abandoned and quit claimed all its rights, title and interest to easements affecting Lot 2A in the Pilgrim Place Subdivision.
