Plymouth Police Department officers responded to Fifth Street and Lake Avenue for an unknown issue after a 911 call Friday, November 24 just before 2 a.m. ET.
Officers encountered a group of people standing outside a residence on Fifth Street and it was determined an argument and possibly a physical altercation had occurred, according to the report.
While officers attempted to investigate the matter Melissa Hernandez, 29, of Plymouth reportedly refused to leave the area and became combative. Police say Hernandez resisted law enforcement and while taking her into custody a male, later identified as Ismel Rodriguez, 24, of Plymouth, allegedly began to interfere and also resisted law enforcement.
Once the group had dispersed, a male who was believed to be intoxicated was seen leaving the area in a vehicle. A traffic stop was conducted and police say the driver, Gerardo J. Trochez-Hernandez, 23, of Plymouth was determined to be operating a vehicle while intoxicated and without ever receiving a license.
All three were taken to the Marshall County Jail. Melissa Hernandez has pending criminal charges of battery, encroachment and disorderly conduct. Rodriguez has pending criminal charges of encroachment, resisting law enforcement and disorderly conduct. Trochez-Hernandez has pending criminal charges of operating while intoxicated and operator never licensed.
Formal charges will be determined by the Marshall County Prosecutor’s Office.
Suspects are considered innocent until proven guilty in a court of law.
