Marshall County Sheriff’s Department deputies made an arrest Sunday, July 9 following an accident.
Marshall County Central Dispatch received a call just after 12:30 a.m. ET regarding a disabled vehicle in the middle of the roadway, in the area of State Road 10 west of Thorn Road.
Police say the driver of the vehicle, identified as Jose Luba of Plymouth, was heading west on State Road 10 and drove off the roadway for an unknown reason before striking a utility pole. The vehicle became disabled in the roadway.
While speaking with Luba, it was determined that there were signs of impairment and was taken to the hospital to receive a certified blood test, according to the report. The test reportedly revealed Luba was over the legal limit of .08. Luba complained of no injuries at the time, but was checked out by hospital staff for jail clearance.
Once released from the hospital, Luba was taken to the Marshall County Jail and booked on a preliminary charge of operating a vehicle while intoxicated.
The Marshall County Sheriff’s Department was assisted at the scene by the Culver Police Department.
Formal charges will be determined by the Marshall County Prosecutor’s Office.
Suspects are presumed innocent unless and until proven guilty in a court of law.
