Marshall County Community Corrections Executive Director Ward Byers touched on Criminal Rule Twenty-Six with advisory board members when they met last week. Byers said the topic was covered when he recently attended a Pre-Trial Summit in Indianapolis with Judge Dean Colvin and Probation Department Officer James Bendy.
He informed them, “What Criminal Rule Twenty-Six looks at is removing or moving people out of the jail on low-risk, low-level felonies or misdemeanors.” Byers continued, “So Criminal Rule Twenty-Six asks us to review and do what’s called the Indiana Risk Assessment/ the Pre-Trial Assessment but also to use mental health and substance abuse screeners.”
Director Byers stated that a portion of a Justice Partners Addictions Response Grant will help pay for an employee who will assist with Criminal Rule Twenty-Six assessments in the County Jail.
He said by conducting these assessments, officials can provide judges with additional details about the individual, aside from the charging information, to allow them to make an informed ruling.
Byers stated that the effects of this policy are not consistent across the board.
He explained, “Criminal Rule Twenty-Six is different in every county. Some counties are saying that it has done great things to reduce their jail population and other counties have said that it has had absolutely no effect on their jail population.”
